GENERAL TERMS AND CONDITIONS HUMANOID WEBSHOP

 

1. Definitions and applicability

1.1. In these terms and conditions, the terms below have the meaning indicated:

- Order: an order for a Product by a Customer;

- HUMANOID: HUMANOID Collective B.V.

- Customer: a natural person who visits the Web Shop or places or wishes to place an Order, not acting in the scope of trading, commercial or professional activities;

- Agreement: the purchase agreement of a Product by the Customer via the Web Shop;

- Product/Products: the product(s) that HUMANOID offers for sale in the Web Shop;

- Web Shop: the web shop under the domain name shophumanoid.com

1.2. These terms and conditions apply to every use of the Web Shop, every offer of HUMANOID in the Web Shop, every purchase of Products via the Web Shop and all Agreements concluded and to be concluded between HUMANOID and the Customer and associated obligations.

 

2. Use of the Web Shop

2.1. The Web Shop may only be used by Customers.

2.2. By using the Web Shop, the Customer agrees:

i) only to use the Web Shop for legitimate purposes or Orders;

ii) not to use the Web Shop in the scope of trading, commercial or professional activities;

iii) to keep his or her (login) data of the Web Shop confidential and not to provide these data to third parties;

iv) not to place any false or fraudulent Orders;

v) to provide HUMANOID the correct (contact) information truthfully and exactly;

vi) that these general terms and conditions apply.

 

3. Offers

3.1. Illustrations of the Products in the Web Shop are indicative. Colours on the Customer’s computer display may differ from the Product’s colours. Sizes specified in the Web Shop are also indicative.

3.2. All offers are without obligation; an Order only binds HUMANOID after HUMANOID has accepted the Order.

3.3. Obvious mistakes or errors in the offer of Products do not bind HUMANOID.

 

4. The price

4.1. The price of the Products is the price specified in the Web Shop, unless an obvious error is involved.

4.2. In the event of obvious errors in prices, HUMANOID will inform the Customer who placed an order of this as soon as possible. The Customer will then have the possibility to confirm the Order at the corrected price or to cancel the Order. In the event that Humanoid fails to contact the Customer, the amount paid by the Customer will be refunded.

4.3. Product prices include any applicable VAT, but do not include shipping costs. The shipping costs will be added to the total amount. The amount of the shipping costs is clearly specified during the order process. For Orders with a value of more than EUR 200.00, HUMANOID will not charge any shipping costs if the order is to be sent to an address within Europe. If the Order is to be sent to an address outside Europe, Humanoid will not charge any shipping costs if the value of the Order exceeds EUR 800.00.

4.4. Prices can be changed at any time. Except for what is stipulated in paragraph 2, this will not affect the Orders that HUMANOID has confirmed.

 

5. Establishment of the Agreement

5.1. An Order is placed by the Customer completing the order process in the Web Shop.

5.2. Subject to what is stipulated in paragraph 3, an Agreement is established once HUMANOID has electronically confirmed the receipt of an Order and the Customer has satisfied the conditions stipulated with the Order.

5.3. In the event that HUMANOID has valid reasons for not entering into the Agreement, it is entitled to refuse an Order or to stipulate special conditions for fulfilment.

 

 

6. Delivery

6.1. Subject to what is stipulated in Article 5, HUMANOID will offer the accepted Orders to the postal service as quickly as possible, but no later than within three days after receipt of the payment, unless a different delivery term has been agreed upon. In the event that the delivery suffers delays or an Order cannot be fulfilled or can only be partially fulfilled, the Customer will be notified of this no later than three days after he or she placed the Order. In that case, the Customer is entitled to dissolve the Agreement at no cost.

6.2. Following dissolution in accordance with the previous paragraph, HUMANOID will immediately repay the amount that the Customer paid.

 

 

7. Payment

7.1. The Customer makes the payment in accordance with the payment methods offered in the order procedure and in accordance with the conditions stipulated.

7.2. The Customer must immediately notify HUMANOID of any inaccuracies in payment information that he or she has provided or specified.

7.3. In the event that the Customer fails to pay, any extrajudicial collection costs will be charged.

 

 

8. Retention of title

8.1. The title to Products only passes to the Customer after the purchase amount has been paid in full.

 

 

9. Right of withdrawal

9.1. During a reflection period of fourteen days (hereinafter: the “Reflection Period”), the Customer can dissolve the Agreement without giving any reasons (hereinafter: the “Right of Withdrawal”).

9.2. The Reflection Period commences on the day on which the Customer or a third party designated by the Customer received the Product. In the event that the Customer ordered several Products in the same Order, the Reflection Period commences on the day on which the Customer or the third party designated by the Customer received the last Product.

9.3. During the Reflection Period, the Customer will handle the Products, the packaging and the labels with care. The Customer will only unpack or use the Product to the extent required to determine the nature and characteristics of the Product. The starting point in this is that the Customer may only use and inspect the Product as is customary in a physical shop.

9.4. The Customer is liable for any decrease in value of the Product that results from any handling by the Customer in breach of the previous paragraph.

9.5. In the event that the Customer wishes to exercise his or her Right of Withdrawal, he or she informs HUMANOID of this within the Reflection Period by means of the return form (click here for the return form) or in another, unambiguous manner.

9.6. The Customer returns the Product (including the labels) as quickly as possible, but in any event within the Reflection Period, to the following address: De Nederlandse e-warehousing, Edisonstraat 78, 6902 PK Zevenaar, the Netherlands.

9.7. The Customer returns the Product together with all accessories delivered, in the original condition and packaging.

9.8. The Customer returns the Product as follows:

i) the Customer logs in into the Web Shop at “my account”, using the login data he or she previously created and selects “returns”. If a Customer is logging in for the first time, he or she must apply for a password;

ii) the Customer selects the order number and the Products that he or she wishes to return;

iii) the Customer selects a carrier;

iv) the Customer prints out the return form (hereinafter: the “Return Form”);

v) the Customer includes the first page of the Return Form with the Product(s) he or she returns;

vi) the costs specified on the Return Form will be paid by the Customer;

vii) the Customer attaches the second page of the Return Form, specifying the UPS barcode and/or return label with address information, to the box or envelope containing the Product(s) that he or she wishes to return. The previous sentence does not apply if the Customer returns the Product(s) via another carrier. The associated costs will in that event be paid by the Customer:

viii) in the event that the Customer has paid by means of a bank transfer or Mister Cash, the Customer must also fill in his or her IBAN number, SWIFT code, name of the bank and the place where the bank is located;

ix) the Customer returns the Product(s) with a tracking number.

9.9. In the event that the Customer opts to use UPS to return the Product(s), the following applies:

i) in the Netherlands, the package can be dropped off at any UPS Access Point. Click here to find your nearest UPS Access Point;

ii) the Customer can also have UPS collect the package. To do this, the Customer can click a UPS icon behind the return in question, where the Customer can schedule a date and address for collection; the Customer can also call 0900 2255 877 (UPS Netherlands) or 078 250 877 (UPS Belgium).

9.10. In the event that the Customer wishes to exchange the Product for another Product, the following applies:

i) the Customer orders a new Product;

ii) the Product that the Customer wishes to return is notified in accordance with the return procedure in conformance with paragraphs 8 and 9;

iii) the Customer includes the comment that this involves an exchange and also specifies the new Order ID;

iv) the Customer sends an e-mail to [email protected] containing the return ID and the new Order ID number;

v) the Customer does not pay any shipping costs for the new Order. Any shipping costs and return costs are cancelled;

vi) HUMANOID sends the new Order in accordance with the stipulations in these terms and conditions after Humanoid has received the returned Products.

9.11. HUMANOID will not accept return shipments if the Customer fails to satisfy the conditions stipulated in this article.

9.12. The risk and the burden of proof for the correct and timely exercise of the Right of Withdrawal fall on the Customer.

9.13. HUMANOID will process return shipments within five working days after receipt and will send the Customer a confirmation e-mail regarding this. If the Customer failed to provide all the information required based on this article, the processing by HUMANOID may take longer.

9.14. HUMANOID compensates the Customer for all payments, including any delivery costs that HUMANOID charged for the returned Product if the entire order of which the returned Product is part of is cancelled, immediately but within thirty days following the day on which the Customer reports the cancellation to HUMANOID.

9.15. For the repayment, HUMANOID uses the same account number that the Customer used for his or her payment, unless agreed otherwise. The repayment does not result in any costs for the Customer.

9.16. Products that the Customer purchased in the Web Shop can only be returned in the manner stipulated in these terms and conditions.

9.17. In the event that the Customer has chosen a more expensive delivery method than the cheapest standard delivery, HUMANOID will not repay the additional costs of the more expensive method.

 

10. Privacy

By providing his or her (personal) data, the Customer agrees that HUMANOID may use these data to contact the Customer and process the data as described in the privacy statement.

 

11. Complaints

11.1. The Customer can submit complaints per e-mail to be sent to [email protected]. HUMANOID will handle complaints within five working days.

 

12. Other provisions

12.1. In the event that one of these terms and conditions is null or voidable, this will not influence the other terms and conditions.

12.2. HUMANOID is entitled to review and amend these general terms and conditions at any time. The general terms and conditions are published here.

 

13. Applicable law

13.1. All Agreements and these terms and conditions are governed exclusively by Dutch law.

 

Sale conditions

HUMANOID uses a different sale date for Belgium, Spain and Portugal to comply with the sale conditions of these countries. Unfortunately, sale conditions are not applicable for orders shipped to Australia and New Zealand, because the different seasons in these countries.

 

Geolocation

For sending out newsletters HUMANOID uses geolocation to estimate the location of where somebody works or lives. Sometimes, geolocation might be incorrect. Unfortunately we cannot prevent this. This can happen if the contact's email service provider uses a proxy or if they connect to the internet with an IP address that changes often.
